Abstract :

Under international law, States retain significant competence in matters of nationality, particularly in determining the conditions for its attribution, acquisition, loss and recovery. In the Democratic Republic of the Congo, this competence forms part of State sovereignty, subject to obligations arising from international law. This article examines the legal framework applicable to statelessness in the Democratic Republic of the Congo in light of international standards on the right to a nationality and the protection of stateless persons. The analysis highlights a contrast between the normative recognition of protective principles and the difficulties involved in ensuring effective protection for persons without a nationality. It particularly underscores the importance of preventing statelessness, identifying affected persons, strengthening civil registration and establishing appropriate protection mechanisms.
